Terms of Service

§1. General Provisions

These Terms of Service (hereinafter: "Terms") define the rules and conditions for using the Smart-Edu.ai website (hereinafter: "Service"), available at https://www.smart-edu.ai.

The owner and operator of the Service is Ecopywriting.pl Karol Leszczyński, registered at: 86-221 Papowo Biskupie 119/18, Poland, Tax ID (NIP): 9562203948, Statistical ID (REGON): 340627879 (hereinafter: "Service Provider").

Using the Service constitutes acceptance of these Terms in their entirety. If the User does not accept any of the provisions of these Terms, they should immediately cease using the Service.

These Terms are made available free of charge on the Service website in a manner that allows obtaining, reproducing, and storing them using the information technology system used by the User.

§2. Definitions

1.Servicethe Smart-Edu.ai online platform available at https://www.smart-edu.ai, through which the Service Provider provides Services.

3.Usera natural person, legal entity, or organizational unit without legal personality that uses the Service.
4.Consumera User who is a natural person performing a legal action not directly related to their business or professional activity (as defined by applicable Polish consumer protection law).
5.Accountthe User's individual profile in the Service, created during the registration process, enabling the placement of Orders and use of Services.
6.Service/Serviceselectronic services consisting of generating text content using artificial intelligence (AI) technology based on parameters specified by the User.
7.Orderthe User's declaration of intent submitted through the Service, aimed at concluding a contract for the provision of Services.
8.Digital Contentcontent generated by the AI system as part of Order fulfillment, delivered to the User in electronic form (HTML, PDF, DOCX).

§3. Technical Requirements

The following are required to use the Service:

a)a device with Internet access (computer, tablet, smartphone)
b)a current version of a web browser (Google Chrome, Mozilla Firefox, Safari, Microsoft Edge) with JavaScript and cookies enabled
c)an active email account

The Service Provider is not responsible for technical problems resulting from the User's failure to meet the above requirements.

§4. Registration and User Account

Registration in the Service is free and voluntary. The User may register through:

a)a registration form by providing an email address and password, with email address verification via a verification code
b)signing in via a Google account (Google Sign-In), under terms specified by Google LLC

The User is obligated to provide true and current information during registration. The User is responsible for maintaining the confidentiality of their Account login credentials.

One Account may be assigned to only one User. Sharing the Account with third parties is prohibited.

The Service Provider reserves the right to suspend or delete the Account of a User who violates the provisions of these Terms, after prior notice to cease violations.

§5. Scope and Nature of Services

The Service enables the generation of text content using artificial intelligence technology. Available content types include, but are not limited to: essays, compositions, reports, argumentative essays, bachelor's theses, and master's theses.

The User specifies Order parameters, including: topic, content type, length (number of characters), language, tone and style, individual guidelines, and optional sources and key phrases.

Content generated by AI is intended solely for informational and educational purposes. The Service is a tool supporting the learning process and content creation. The User bears full responsibility for how they use the generated content.

The Service Provider does not guarantee that generated content will meet specific formal requirements of educational institutions, reviewers, or examination committees.

The Service Provider makes every effort to ensure that generated content is of the highest quality; however, it is not responsible for any substantive, stylistic, or factual errors resulting from the operation of AI algorithms.

§6. Placing Orders and Service Fulfillment

Orders are placed by the User through a form available after logging into their Account.

After completing the Order form and confirming its contents, the User is redirected to the Stripe payment system to make payment.

The contract for the provision of Services is concluded upon positive payment verification by the payment operator Stripe.

Order fulfillment begins automatically after payment confirmation. The content generation process includes: searching and analyzing Internet sources, creating the text structure, generating the actual content, and — for academic works — preparing the bibliography.

The estimated Order fulfillment time is from 5 to 50 minutes depending on the type and length of the ordered text. The Service Provider does not guarantee exact fulfillment times.

Generated content is available in the User's dashboard in the following formats: HTML preview, PDF file, and DOCX file. The User may also edit the generated content directly within the Service.

§7. Prices and Payments

Service prices are listed in the Service in Polish zloty (PLN) or US dollars (USD) and include all taxes required by law.

The Order price depends on the type of text, its length (number of characters), and additional options selected by the User. The final price is presented to the User before payment is made.

PLN/USD currency conversion is based on the current average exchange rate published by the National Bank of Poland (NBP, Table A), retrieved in real time.

Payments are processed by an external payment operator — Stripe, Inc. Available payment methods include: credit and debit cards (Visa, Mastercard, and others) and BLIK (for PLN payments). The Service Provider does not store User payment card data.

In case of payment problems, the User should contact the Service Provider using the contact details provided in §14.

§8. No Right of Withdrawal — Digital Content

In accordance with Article 38(13) of the Polish Act of May 30, 2014 on Consumer Rights (Journal of Laws 2014, item 827, as amended), the Consumer does not have the right to withdraw from a contract for the supply of digital content not supplied on a tangible medium if performance has begun with the Consumer's express and prior consent before the expiry of the withdrawal period and after informing the Consumer of the loss of the right of withdrawal.

By placing an Order and making payment, the User:

a)consents to the commencement of Service provision (digital content generation) immediately after payment confirmation, i.e., before the expiry of the 14-day withdrawal period
b)confirms that they have been informed of the loss of the right of withdrawal upon commencement of service provision
c)acknowledges that once the AI system begins generating content, the Service is deemed fulfilled and is not subject to refund

The above exclusion of the right of withdrawal also applies in situations where the generated content does not meet the User's subjective expectations, as the Service consists of delivering digital content generated in accordance with the parameters provided by the User.

In the event of an objective technical failure of the Service that prevents Order fulfillment (e.g., no content generated whatsoever), the Service Provider will refund the payment or re-fulfill the Order — at the User's choice.

§9. Complaints

The User has the right to file a complaint in case of non-performance or improper performance of the Service by the Service Provider.

Complaints should be submitted electronically to the email address: kontakt@smart-edu.ai, providing: data identifying the User (email address, Order number), a description of the problem, and the expected resolution method.

The Service Provider will process the complaint within 14 days of receipt and will inform the User of the resolution method via email.

A complaint is not applicable when the User's dissatisfaction stems from a subjective assessment of the quality of content generated in accordance with the provided Order parameters.

§10. Copyright and License

Content generated as part of Order fulfillment may constitute a work within the meaning of applicable copyright law, provided it meets the relevant legal criteria. The legal qualification of AI-generated content is subject to currently applicable laws and their interpretation.

Upon payment for the Order and delivery of the content, the Service Provider grants the User a non-exclusive, territorially unlimited license to use the generated content in the following fields of exploitation: recording and reproduction (including digital), modification and development, use for educational, personal, and commercial purposes.

The User acknowledges that AI-generated content may exhibit similarities to content generated for other Users on similar topics. The Service Provider does not guarantee content exclusivity.

The Smart-Edu.ai Service, its name, logo, graphic design, software, databases, and all elements of the Service are the property of the Service Provider and are protected by law. Their copying, distribution, or use without the written consent of the Service Provider is prohibited.

§11. Liability

The Service Provider provides Services with due diligence; however, it is not liable for:

a)the way the User uses the generated content, including violations of educational institution regulations or laws by the User
b)substantive, stylistic, or factual errors in content generated by the AI system
c)temporary unavailability of the Service due to technical reasons (maintenance, failures, updates)
d)actions or omissions of third parties (payment operators, hosting service providers, API providers)
e)damages resulting from the User's violation of the provisions of these Terms

The Service Provider's liability towards Users who are not Consumers is limited to the amount of the price paid for the given Order.

§12. Personal Data Protection

The data controller for Users' personal data is the Service Provider: Ecopywriting.pl Karol Leszczyński, NIP: 9562203948.

Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR) and applicable Polish data protection legislation.

Personal data is processed for the purpose of: fulfilling Services and processing Orders (Art. 6(1)(b) GDPR), complying with legal obligations, including accounting and tax obligations (Art. 6(1)(c) GDPR), pursuing claims or defending against them (Art. 6(1)(f) GDPR).

Personal data may be disclosed to the following categories of recipients: Stripe, Inc. — for payment processing, Google LLC — for Google Sign-In authentication and Google reCAPTCHA service, Amazon Web Services (AWS) — for Service infrastructure hosting, Anthropic — for processing queries through the AI model.

The User has the right to: access their data, rectify it, erase it ("right to be forgotten"), restrict processing, data portability, object to processing, and lodge a complaint with the relevant data protection supervisory authority.

The Service uses Google reCAPTCHA technology to protect against automated access (bots). The use of reCAPTCHA is subject to Google's Privacy Policy and Terms of Service.

§13. Final Provisions

The Service Provider reserves the right to amend these Terms. Users will be notified of any changes at least 14 days in advance via the email address associated with their Account.

Changes to the Terms take effect on the date specified in the notification, no earlier than 14 days from the date of sending. Use of the Service after the changes take effect constitutes acceptance of those changes.

Matters not regulated by these Terms shall be governed by the laws of the Republic of Poland, in particular the Civil Code, the Act on Consumer Rights, and the Act on Provision of Electronic Services.

Any disputes between the Service Provider and a User who is not a Consumer shall be resolved by the court competent for the Service Provider's registered office. Consumers may use out-of-court complaint and claim resolution methods, including through the ODR platform: https://ec.europa.eu/consumers/odr/.

These Terms are effective as of February 17, 2026.
