Terms of Service

These Terms of Service (hereinafter: "Terms") define the rules and conditions for using the Smart-Edu.ai website (hereinafter: "Service"), available at https://www.smart-edu.ai.

The owner and operator of the Service is Ecopywriting.pl Karol Leszczyński, registered at: 86-221 Papowo Biskupie 119/18, Poland, Tax ID (NIP): 9562203948, Statistical ID (REGON): 340627879 (hereinafter: "Service Provider").

These Terms form part of every contract concluded through the Service; the User accepts them when registering an Account, and the Order form refers to their current wording. Each Order is governed by the version of the Terms in force when it is placed. Merely browsing the publicly available pages of the Service does not create any contractual obligations for the User.

These Terms are made available free of charge on the Service website in a manner that allows obtaining, reproducing, and storing them using the information technology system used by the User.

The Service Provider is not responsible for technical problems resulting from the User's failure to meet the above requirements.

Registration in the Service is free and voluntary. The User may register through:

The User is obligated to provide true and current information during registration. The User is responsible for maintaining the confidentiality of their Account login credentials.

One Account may be assigned to only one User. Sharing the Account with third parties is prohibited.

The Service Provider reserves the right to suspend or delete the Account of a User who violates the provisions of these Terms, after prior notice to cease violations.

The Service enables the generation of text content using artificial intelligence technology. Available content types include, but are not limited to: essays, compositions, reports, argumentative essays, bachelor's theses, and master's theses.

The User specifies Order parameters, including: topic, content type, length (number of characters), language, tone and style, individual guidelines, and optional sources and key phrases.

The Service Provider does not guarantee that generated content will meet specific formal requirements of educational institutions, reviewers, or examination committees.

The Service Provider verifies the sources used by automated means; nevertheless, AI-generated content may contain factual errors. Before using the content, the User should check its statements, quotations and source references. This does not limit the Consumer's rights in the event of lack of conformity of the digital content with the contract (§9).

Orders are placed by the User through a form available after logging into their Account.

After completing the Order form and confirming its contents, the User is redirected to the Stripe payment system to make payment.

The contract for the provision of Services is concluded upon positive payment verification by the payment operator Stripe.

Order fulfillment begins automatically after payment confirmation. The content generation process includes: searching for and verifying academic sources through the external cytado.com search engine, creating the text structure, generating the actual content, and — for academic works — preparing the bibliography.

The estimated Order fulfillment time is from 5 to 50 minutes depending on the type and length of the ordered text. The Service Provider does not guarantee exact fulfillment times.

Generated content is available in the User's dashboard in the following formats: HTML preview, PDF file, and DOCX file. The User may also edit the generated content directly within the Service. The PDF, DOCX and HTML files provided carry a machine-readable marking in their metadata identifying the content as AI-generated (Article 50(2) of Regulation (EU) 2024/1689).

Service prices are listed in the Service in Polish zloty (PLN), US dollars (USD) or euros (EUR) and are final prices. The Service Provider is exempt from VAT under Article 113(1) of the Polish Act of 11 March 2004 on Goods and Services Tax, so no VAT or any other charges are added to the price.

The Order price depends on the type of text, its length (number of characters), and additional options selected by the User. The final price is presented to the User before payment is made.

USD and EUR prices are converted from the PLN price list based on the current average exchange rate published by the National Bank of Poland (NBP, Table A), retrieved in real time.

Payments are processed by an external payment operator — Stripe, Inc. Available payment methods include: credit and debit cards (Visa, Mastercard, and others), BLIK and Przelewy24 (for PLN payments), and Revolut Pay. The Service Provider does not store User payment card data.

In case of payment problems, the User should contact the Service Provider using the contact details provided in §14.

In the Smart-Edu.ai Android app, payments are handled by Google Play (Google Commerce Ltd acts as the seller of digital content for VAT purposes). Prices in the app are the same as in the Service; refunds of in-app purchases are handled by Google under the Google Play rules, while complaints about Service quality are handled by the Service Provider under §9.

This section applies to Consumers and to natural persons concluding a contract directly related to their business activity where the content of the contract shows that it is not of a professional nature for them (Article 38a of the Polish Consumer Rights Act).

Withdrawal information

Right of withdrawal. The Consumer has the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day of the conclusion of the contract (§6(3)). To exercise the right of withdrawal, the Consumer must inform the Service Provider (Ecopywriting.pl Karol Leszczyński, 86-221 Papowo Biskupie 119/18, Poland, email: kontakt@smart-edu.ai) of the decision to withdraw from this contract by an unequivocal statement (e.g. an email). The Consumer may use the model withdrawal form attached to these Terms as an Annex, but it is not obligatory. To meet the withdrawal deadline, it is sufficient to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal. If the Consumer withdraws from this contract, the Service Provider shall reimburse all payments received from the Consumer without undue delay and in any event not later than 14 days from the day on which the Service Provider is informed about the decision to withdraw from this contract. The reimbursement is made using the same means of payment as the Consumer used for the initial transaction, unless the Consumer has expressly agreed otherwise; in any event, the Consumer will not incur any fees as a result of such reimbursement.

Loss of the right of withdrawal. The right of withdrawal expires once the generation of the digital content begins, provided that before placing the Order the Consumer gave express prior consent to the commencement of performance before the end of the withdrawal period and acknowledged the loss of the right of withdrawal (rules below). Generation starts automatically immediately after payment confirmation.

Before placing an Order, the User ticks a separate statement in the order form by which the User:

The above exclusion of the right of withdrawal also applies in situations where the generated content does not meet the User's subjective expectations, as the Service consists of delivering digital content generated in accordance with the parameters provided by the User.

In the event of an objective technical failure of the Service that prevents Order fulfillment (e.g., no content generated whatsoever), the Service Provider will refund the payment or re-fulfill the Order — at the User's choice.

The User receives confirmation of the contract on a durable medium — an email sent after payment confirmation — including the wording of the consent statement with the date and time it was given, the Service Provider's details and information on the complaints procedure.

The loss of the right of withdrawal does not affect the User's rights in the event that the digital content does not conform to the contract, nor the right to file a complaint (§9).

The Service Provider is obliged to supply digital content that is in conformity with the contract. If the digital content is not in conformity with the contract, the Consumer has the rights set out in Chapter 5b of the Polish Act on Consumer Rights: to have the content brought into conformity (a free correction or regeneration) and, in the cases specified in the Act, to a price reduction or to withdraw from the contract with a refund of the price. A User who is not a Consumer may also file a complaint in case of non-performance or improper performance of the Service.

The easiest way to file a complaint is by email to kontakt@smart-edu.ai. To speed up processing, please provide: the email address of your Account, the Order number, a description of the problem, and the resolution you expect.

The Service Provider will process the complaint within 14 days of receipt and will inform the User of the resolution method via email.

Digital content is not in conformity with the contract in particular where it has not been supplied or has been supplied incomplete, where it does not match the topic, text type or language of the Order, where it is shorter than the ordered number of characters by more than 15%, where it lacks the bibliography appropriate to the text type, where it cites sources that do not exist, or where the files provided cannot be opened. The mere fact that the style, line of argument or emphasis does not match the User's personal preferences does not constitute a lack of conformity, provided that the content matches the Order parameters and the description of the Service in §5.

Content generated as part of Order fulfillment may constitute a work within the meaning of applicable copyright law, provided it meets the relevant legal criteria. The legal qualification of AI-generated content is subject to currently applicable laws and their interpretation.

Upon payment for the Order and delivery of the content, the Service Provider grants the User a non-exclusive, territorially unlimited license to use the generated content in the following fields of exploitation: recording and reproduction (including digital), modification and development, use for educational, personal, and commercial purposes.

The User acknowledges that AI-generated content may exhibit similarities to content generated for other Users on similar topics. The Service Provider does not guarantee content exclusivity.

The Smart-Edu.ai Service, its name, logo, graphic design, software, databases, and all elements of the Service are the property of the Service Provider and are protected by law. Their copying, distribution, or use without the written consent of the Service Provider is prohibited.

The Service Provider provides the Services with due diligence and is liable for non-performance or improper performance of the contract in accordance with the applicable law. In particular:

The Service Provider's liability towards Users who are not Consumers is limited to the amount of the price paid for the given Order.

The data controller for Users' personal data is the Service Provider: Ecopywriting.pl Karol Leszczyński, NIP: 9562203948.

Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR) and applicable Polish data protection legislation.

Personal data is processed for the purpose of: fulfilling Services and processing Orders (Art. 6(1)(b) GDPR), complying with legal obligations, including accounting and tax obligations (Art. 6(1)(c) GDPR), pursuing claims or defending against them (Art. 6(1)(f) GDPR).

Personal data may be disclosed to the following categories of recipients: Stripe, Inc. — for payment processing, Google LLC — for Google Sign-In authentication and Google reCAPTCHA service, Amazon Web Services (AWS) — for Service infrastructure hosting, Anthropic — for processing queries through the AI model, cytado.com (Ecopywriting.pl Karol Leszczyński) — for searching academic sources; only data necessary for the search (topic, optional outline, language) is transferred, without any personal data of the User.

The User has the right to: access their data, rectify it, erase it ("right to be forgotten"), restrict processing, data portability, object to processing, and lodge a complaint with the relevant data protection supervisory authority.

The Service uses Google reCAPTCHA technology to protect against automated access (bots). The use of reCAPTCHA is subject to Google's Privacy Policy and Terms of Service.

The Service Provider may amend these Terms for important reasons: a change in the law or in its interpretation affecting the content of the Terms, the introduction of new or changes to existing features of the Service, a change in payment methods or payment providers, a change in the Service Provider's details, or the need to remove ambiguities or errors. Users who have an Account will be notified of changes at least 14 days in advance via the email address associated with their Account.

The amended Terms apply to Orders placed after they take effect; Orders placed earlier remain governed by the version in force when they were placed. A User who does not accept the changes may delete their Account at any time free of charge.

Matters not regulated by these Terms shall be governed by the laws of the Republic of Poland, in particular the Civil Code, the Act on Consumer Rights, and the Act on Provision of Electronic Services. The choice of Polish law does not deprive a Consumer habitually resident in another Member State of the European Union of the protection afforded by the mandatory provisions of the law of that State.

Any disputes between the Service Provider and a User who is not a Consumer shall be resolved by the court competent for the Service Provider's registered office. Consumers may use out-of-court complaint and redress procedures, for example by contacting a municipal or district consumer ombudsman or a regional inspectorate of the Trade Inspection in Poland; information on these procedures is available at https://polubowne.uokik.gov.pl.
